Outfielder Marcell Ozuna of the Atlanta Braves was detained in Gwinnett County and accused of driving under the influence. According to Channel 2, Ozuna, 31, was apprehended by Norcross police early on Friday and lodged in the Gwinnett County Jail. He was also accused of swerving out of his lane while driving.
A domestic incident at Ozuna's Sandy Springs home led to his arrest 15 months prior to the current incident. During an argument, he is alleged to have choked his wife and thrown her against a wall. Ozuna was charged with felony aggravated assault at first, but the charges were dropped to the battery and simple assault with family violence enhancements.
In the confines of his Sandy Springs home, Ozuna is alleged to have assaulted and strangled his estranged wife. According to court records, she told officers that she and her husband had gotten into a fight about adultery before he choked her and pushed her against a wall. The felony charge of aggravated assault by strangulation that led to his initial arrest was dropped by the prosecution in July. Ozuna was still facing simple assault and battery with a deadly weapon misdemeanor charges.
In exchange for having his case fully dropped, Ozuna agreed in September to complete the state's pre-trial diversion program, which enables offenders to complete requirements before appearing in court. Under the terms of the agreement, Ozuna had to finish a number of things within six months. One of these was a family violence intervention program.
The outfielder had previously been placed on administrative leave while the inquiry was ongoing, but Major League Baseball retrospectively punished him for 20 games without pay. This year, Ozuna returned to the group.
